This Privacy Policy describes Monte Carlo Data, Inc.’s (“Monte Carlo,” “we,” “us,” “our”) information collection and use practices with respect to Personal Information (as defined below). We collect Personal Information from and about Monte Carlo customers and people interested in Monte Carlo’s Services who visit our website or use our services. The information we collect will depend on your relationship to us. By using or accessing our products, services or website (collectively, “Services”) in any manner, you acknowledge that such use and/or access is subject to the practices and policies outlined in this Privacy Policy.

Remember that this Privacy Policy is incorporated into any terms and conditions that have been previously agreed with respect to your use of our Services. Any terms we use in this Privacy Policy without defining them have the definitions given to them in such terms and conditions.

What does this Privacy Policy cover?

This Privacy Policy covers our treatment of personally identifiable information (“Personal Information”) that we gather from website visitors, third party business partners and service providers, or customers accessing or using our Services, but not to the practices of companies we don’t own or control, or people that we don’t manage. “Personal Information” includes data that relates to, describes, can be used to contact, or could reasonably be linked directly or indirectly to you, including, for example, identifiers such as your real name, postal address, online identifier, Internet Protocol (IP) address, email address, account name, or other similar identifiers. When applications or other solutions are provided by us and they link to this Privacy Policy, this Privacy Policy applies. When offerings are provided by third parties, the privacy statement of the third party applies and this Privacy Policy does not.

What Information does the Company Collect

Information You Provide to Us:

We collect information that you provide to us. For example, if you sign up for a product demo or are a customer, we may collect Personal Information such as your name, email address, and phone number. If you are a customer or an employee of a customer, certain additional information may be required to register an account or to take advantage of some of our Service features. We also collect information if you fill out a demo request form (or other form), apply for a job, engage with us through online chat applications, engage with Monte Carlo marketing activities, or request customer support.

We may communicate with you if you’ve provided us the means to do so. For example, if you’ve given us your email address, we may send you promotional email offers on behalf of other businesses. If you are a customer or employee of a customer, we may email you about your use of the Services. We may receive a confirmation when you open an email from us. This confirmation helps us make our communications with you more interesting and improve our Services.

Information Collected Automatically

When you interact with our Services as a website visitor or employee of a customer, we automatically receive and record information on our server logs from your browser or device, which may include your IP address, geolocation data, device identification, “cookie” information, the type of browser and/or device you’re using to access our Services, and the page or feature you requested. We may use this data to customize content for you that we think you might like, based on your usage patterns. We may also use it to improve the Services. For example, this data can tell us how often users use a particular feature of the Services, and we can use that knowledge to make the Services interesting to as many users as possible.

Information Provided by Others:

Our customers, business partners and service providers may provide us with information about you. Customers may provide us the names and business emails of their employees to help us to create accounts for those individuals, as well as Personal Information of their own customers. If as a customer, you access our Services through a third-party service, or connect an application to our Service, that third party may pass certain information about your use of its service to Monte Carlo.

We Combine Information

We may combine information that we have collected offline with information we collect online. We combine information that we have collected across other third party sites. We combine information across devices, such as computers and mobile devices. We may also combine information we get from a third party with information we already have.

Will Company Share Any of the Personal Information it Receives?

Monte Carlo does not and will not sell your Personal Information. We may, however, share your Personal Information with third parties as described in this section:

Vendors/Subprocessors: We employ other companies and people to perform tasks on our behalf and may need to share your Personal Information with them to provide the Services to you, which may include for the creation and maintenance of accounts, collection and analysis of data, provision of technical support, or provision of specific business services such as synchronization with other software applications and marketing services. Vendors and Subprocessors are permitted to use the Personal Information we share with them only as necessary to assist us in the provision of the Services and are required by written agreement not to retain, use or disclose your Personal Information for any other purpose.

Business Transfers: We may choose to buy or sell assets or our company and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.

Protection of Company and Others: We may access, read, preserve, and disclose any information that we believe is necessary to comply with law or court order; enforce or apply our terms and conditions and other agreements; or protect the rights, property, or safety and security of Monte Carlo, our employees, our users, or others.

Security Of Your Personal Information

We use a variety of industry-standard security measures to help protect your Personal Information as required by relevant law. We also require you to enter a password to access your account information. Please do not disclose your account password to unauthorized persons. Although we are committed to protecting your Personal Information, we cannot guarantee the security of your information transmitted to our site; any transmission is at your own risk. Additionally, our customers and your employer must prevent unauthorized access to accounts and Personal Information by selecting and protecting passwords appropriately and limiting access to your computer or device and browser.

How Is My Personal Information Retained?

We keep Personal Information as long as it is necessary or relevant for the purposes for which it was collected and in compliance with our retention policies. We also keep information as otherwise required by law.

To determine the appropriate retention period for Personal Information, we consider not only applicable legal requirements, but also the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means.

What Choices Do I Have Regarding My Personal Information?

You can choose not to disclose Personal Information to us, but keep in mind that if you are a customer or an employee of a customer, some Personal Information may be needed to register with us or to take advantage of some of our Service features.

To stop receiving our promotional emails follow the instructions in any promotional message you get from us or contact us as described at the end of this Privacy Policy. If you opt out of getting marketing messages, you will continue to receive messages from us about your relationship with us where permitted by law.

You may request deletion of your information or account by sending a request to privacy@montecarlodata.com. If you are an employee of one of our customers, we will refer your request to that Monte Carlo customer. Some information may remain in our records after your deletion request.

Your Legal Rights Regarding Your Personal Information

Under certain circumstances you may have rights under applicable data protection laws in relation to your Personal Information. Where applicable, you may have the right to:

  • Request information about how we collect, process, use and share your Personal Information (commonly known as a “right to know request”).
  • Request access to your Personal Data (commonly known as a “data subject access request”). This enables you to receive a copy of the Personal Information we hold about you and to check that we are lawfully processing it.
  • Request correction of the Personal Information that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure of your Personal Information (commonly known as a “request to be forgotten”). This enables you to ask us to delete or remove Personal Information. You also have the right to ask us to delete or remove your Personal Information where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your Personal Information to comply with local law. Note, however, that we may not always be able to comply in full with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  • Object to processing of your Personal Information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your Personal Information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  • Request restriction of processing of your Personal Information. This enables you to ask us to suspend the processing of your Personal Information in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  • Request the transfer of your Personal Information to you or to a third party. We will provide to you, or a third party you have chosen, your Personal Information in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
  • Withdraw consent at any time where we are relying on consent to process your Personal Information. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain Services to you. We will advise you if this is the case at the time you withdraw your consent.

If you wish to exercise any of the above rights please contact privacy@montecarlodata.com. You will not have to pay a fee to access your Personal Information (or to exercise any of the other rights), and Monte Carlo does not discriminate based on whether you choose to exercise your choice and rights. We will not, based on your exercise of rights, deny our Services to you, charge you different rates, provide a different level or quality of Services to you, or suggest that you may receive such different treatment. However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive.

Additionally, we may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights). This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it. As part of the verification process, we match the information submitted as part of your request against information stored by Monte Carlo. In some instances, we will require additional information in order to verify your request. If an authorized third party makes a data subject request on your behalf, we will require sufficient written proof that you have designated them as your authorized agent. We try to respond to all legitimate requests within 30 days. Occasionally it may take us longer than 30 days if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

California Residents’ Rights
Subject to certain limitations, the California Consumer Privacy Act (“CCPA”) provides California consumers the right to request to know more details about the categories or specific pieces of Personal Information we collect (including how we use and disclose this information), to delete their Personal Information, to opt out of any “sales” that may be occurring, and to not be discriminated against for exercising these rights. If you are submitting on someone else’s behalf, we may ask for additional information to verify your identity. This may include providing a signed letter verifying your right to make this request. We do not sell Personal Information to third parties for money or any other consideration, as that term is generally understood. We do not sell Personal Information of minors under the age of 16. We will not discriminate against you because you have exercised any of your rights under the CCPA.

For EU, UK and Swiss Residents
If Personal Information pertaining to you as an individual has been submitted to the Services by or on behalf of one of our customers and you wish to exercise any data protection rights you may have in respect of that data under applicable law, including (as applicable) the right to access, port, correct, amend or delete such data, please inquire with the relevant Monte Carlo customer directly. We have a limited ability to access the content of our customers. However, if you wish to make your request directly to us, please provide the name of the Monte Carlo customer who submitted your data to our Services. We will refer your request to that Monte Carlo customer.

Data Privacy Framework Statement

Monte Carlo complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. This includes with respect to Personal Information provided to us by our customers for processing on behalf of the customer in the provision of our Services.  

Monte Carlo has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of Personal Information transferred from the European Union and the United Kingdom (and Gibraltar), and the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of Personal Information transferred from Switzerland.  If there is any conflict between the terms in this Privacy Policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern.  To learn more about the Data Privacy Framework (DPF) program, and to view our certification, please visit https://www.dataprivacyframework.gov/.

Monte Carlo uses third party subprocessors to help us provide our Services and those subprocessors may process Personal Information. Monte Carlo remains responsible and liable under the DPF Principles for our third party subprocessors as set forth in the DPF Principles.

In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, Monte Carlo commits to resolve DPF Principles-related complaints about our collection and use of your Personal Information.  EU, UK and Swiss individuals with inquiries or complaints regarding our handling of Personal Information received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, should first contact Monte Carlo at: privacy@montecarlodata.com. For any complaints that cannot be resolved with Monte Carlo directly, Monte Carlo has chosen to cooperate, for the purposes of the DPF Principles, with the JAMS DPF Program. Information on how to contact JAMS is available at https://www.jamsadr.com/dpf-dispute-resolution. Under certain conditions, as further explained in the DPF Principles, you may be entitled to invoke binding arbitration when other dispute resolution procedures have been exhausted. Monte Carlo is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission.

Under certain circumstances, Monte Carlo may be required to disclose Personal Information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Our Services Are Not Intended For Children

We do not knowingly collect or solicit Personal Information from children under the age of 13. If you are under 13, please do not attempt to register for the Services or send any personal information about yourself to us. Third Party Sites And Services

If you click on a link to a third party website or service, a third party may also transmit cookies to you. Again, this Privacy Policy does not cover the use of cookies by any third parties, and we aren’t responsible for their privacy policies and practices. Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our Services, and those third parties may not honor “Do Not Track” requests you have set using your browser or device.

Updates To This Privacy Policy

We may change this Privacy Policy from time to time. We will notify you of any material changes to our Privacy Policy as required by law. We will also post an updated copy on the sites where this appears. Please check our site periodically for updates.
